Hmm.... I don't believe his response. Sounds like it is a pirate, and he wants to 'pay you out' (and keep you quiet) so that he can continue selling them.

That may be true as he hasnt yet sent any money to me. He says he is waiting for his sister to transfer the money over into his account as he was selling the dvds on her behalf. He does seem quite apolgetic about it all though.

I had a similar case where I bought a record on ebay and it arrived broken due to his poor packaging, the guy said he would send the money back, and never did, he kept saying he would though so I didnt get a chance to leave bad feedback.
