It's going to be a long trial.

No, it won't be a trial, cause it's not a "fault" thing---it's me goin' in for the citation, "leaving the scene of an accident". Which, in my mentality at the time, I did not do. I just thought it was one o' those things on a back road, and I've heard of worse where nobody even had to go to court.

That's what my court deal is about, doin' the thing I wasn't aware I was doin'.

Just one o' those li'l things in life we all learn from...

Yeah but Byron, 'My mentality at the time' isn't a valid enough reason to a court of law. Having a license you're supposed to be in a fit enough state to assess a situation correctly. I think it's a good defence that the area wasn't a great one to stop so you drove to the nearest safest place and then stopped. I think then there is some argument that you had reason to leave the scene but i think using the defence that you weren't aware it was an accident and the accident wasn't that big a deal is a very bad one and they are gonna come down on you like a ton of bricks if you go that route because it makes it sound like you aren't a responsible enough driver. Anytime you draw blood whether it is with criminal intent or not a court will NOT see it as extremely minor, and if you accept some of the guilt it'll look a lot better on you in front of a judge.

Actually Luke, everyone here is tellin' me the opposite, and I believe 'em. I can't tell you how many times I have been told not to worry, they (people I've talked to) would have done the same thing, etc. With the conditions and circumstances, they tell me my side of the story, my honesty, is what is gonna keep me in favor, especially since it is not that serious (even hearin' this from a retired state trooper), and make this all easier on me.

And his arm had the couple o' little cuts cause their window was down (not even listed as an injury, he said he was fine). I accept my part in this, I just hope the other boys do also---they were speeding very fast, which put me in a panic (there was a drop-off on the other side of me, and I was tryin' to turn my fog lights on).

By the way, I didn't notice them stop either after it happened, and like I said, I thought my mirror was the only damaged thing in this---so why bother to stop? It wasn't until a couple of minutes later I saw 'em followin' me, and decided to pull over into saftey---otherwise I may not be here right now (ya just don't know people nowadays).

My mom was in an accident once where some people in another car were speeding, and they either took a corner real fast or ran a red light - I forget. Mom wasn't hurt much, but the car was totaled and the police said anyone with her in the car would've probably been killed. Then these guys turned around and tried to pin the thing on my mom. It took quite a while before the whole thing got straightened out, but it did eventually, and Mom was in the clear. I'm just glad nobody was hurt; it could've been so much worse! I don't know much about these things, Byron, but if you stand your ground I can't imagine that they would fault you, or at least not much. I'm sure I would've done the same thing, and most people would've. Hope it all goes well!

I guess the law is a little different here but actually with some of those extra facts you mentioned (them not stopping, cuts not being listed) i kinda get your side of it now a lot more so yeah you may well be doing the right thing. I wouldn't depend on the other boys saying anything to help you (amazing how peoples memories change once they get into court) but you never know. If it starts to look anything but good i'd get a decent lawyer or something but certainly if i was driving and something happened i couldn't see myself stopping in a dangerous place and with who knows what kinda people after you.

Thanks Erin and Luke...about the court appearance though, it'll be just me. It's not a "____ vs. ____" deal, it's the kind where each a bunch of people show up at 9 a.m., and they handle each individual one by one. So when I'm called, I'll present my story, and that's it.
