Disney no longer holds the licensing rights to the RCMP's trademarks, including the Mountie likeness. One of the characters I have used for years - Marshall Mountie - traditionally wears a Mountie-like uniform. What I've done to avoid problems is make sure the uniform is not an exact copy of the traditional Mountie uniform and a few years back I dropped the "Mountie" part of his name because that is technically an RCMP trademark.

The RCMP is pretty cool about their traditional uniform appearing in theatre, film, etc. as long as what you're doing is not defammatory. The best thing to do is contact their public relations department and make an enquiry before doing anything that's heavily dependent on a Mountie character.

For fun, I did a quick trademark search and the RCMP hasn't registered "Mountie" as a trademark (that doesn't mean it isn't a trademark, just that they haven't bothered to register it) but I think you're right, it is a common word. The problem is the uniform and Mountie image, which the RCMP does own the intellectual property rights to. If you pick up any Mountie merchandise in Canadian shops you'll see somewhere on the bottom or on a tag that it's been licensed by the RCMP.

For years the RCMP didn't enforce their ownership of the image, but that changed a few years back because they were concerned with maintaining their image and stopping people from producing shoddy merchandise. Disney had the licensing rights for the first five years of the licensing program, but those have reverted to the RCMP again. All the money they make off licensing goes to fund community safety programs the RCMP is involved with. I think their licensing program is generally concerned with merchandise and they're generally cool about people using Mountie-like uniforms in film and TV as long as the usage isn't disrespectful.

There's some more info about this available at http://www.mountieshop.com/about_the_foundation.asp

It boggles my mind that an American company (Disney) can own the licensing for another country's police. I could just imagine if everytime you wanted an LA cop in a movie, you had to get clearance from Rupert Murdoch.
