Don't copyrights extend for 75 years? Regardless of whether or not the copyrighted item is in use, the copyright is still in effect.

It's a common email scam. I've even received the same thing snail mail at my office. Check snopes.com to read about the different incarnations of the scam. Speaking of snopes, they're always a great resource if you get anything that seems shady thru email.
